Former Penn State Trustee, Having Initiated a Lawsuit to Access Elevate Agreement Details, Expresses Ongoingapprehensions

Penn State University has entered into a significant partnership with Elevate Sports Ventures, a sports and entertainment firm, aiming to boost the university's athletics department economically. The expanded collaboration, announced in August last year, is expected to last over a decade and will see Elevate becoming a strategic and financial partner in creating collective value, particularly for large-scale infrastructure projects like the Beaver Stadium renovation.

The partnership does not involve Elevate buying Penn State’s sports program but rather focuses on generating new revenue streams and efficiently managing premium asset utilization. For instance, the renovation of Beaver Stadium is designed to help Penn State monetize the project effectively by capitalizing on premium spaces and enhancing fan experience facilities that can command higher revenues.

The Beaver Stadium renovation project is projected to generate nearly $10.4 billion over the next 30 years, resulting in a revenue surplus of approximately $43.7 million in the best-case scenario. However, the worst-case scenario projects a $56.8 million deficit. The partnership is aligned with the broader trend of universities seeking innovative revenue sources to support capital projects.

Elevate's model includes offering services normally associated with NIL (Name, Image, Likeness) collectives, deal facilitation, athlete support, and commercial asset management, enabling Penn State to tap into previously underutilized revenue opportunities. Elevate's ownership stake and long-standing experience in the sports and entertainment sectors position it well to contribute meaningfully to Penn State’s ability to fund the stadium renovation through new commercial strategies and partnerships.

However, the precise scope and financial architecture of Penn State's partnership with Elevate remain hidden from public view due to Penn State's unusual legal classification. Barry Fenchak, a member of Penn State's Board of Trustees, sought access to the agreement to verify its hype but was initially denied. After months of litigation, the university provided Fenchak with the agreement earlier this year. Fenchak argued that reviewing the Elevate contract fell squarely within his fiduciary responsibilities.

The partnership between Penn State University and Elevate Sports Ventures is a significant step towards maximizing the commercial potential of Penn State's properties amidst the evolving college athletics landscape, without the university selling its sports program itself. Despite the secrecy surrounding the agreement, the partnership is expected to play a crucial role in helping Penn State pay off and maximize revenue from its ongoing $700 million renovation of Beaver Stadium.
